Know your rights after a motorcycle crash

Motorcycle accidents happen for many reasons, but when it comes down to it, it's normally human error that is the main factor. If you're riding a motorcycle and are hit, the last thing on your mind at that moment is a lawsuit. You just want to survive and get better. You want the driver who hit you to be held responsible.

It's important to understand your rights when an accident happens. There are some cases where fault is obvious, but others aren't as clear. Here are a few things to keep in mind.

1. Comparative negligence could impact your case

Comparative negligence is when two or more people are responsible for causing a crash and share fault. For instance, if the vehicle that hit you had the right of way but the driver could have stopped if not for texting at the time of the crash, both you and the driver may be partially at fault for the collision.

2. Saying you're sorry can put you at fault

Never say anything that makes it seem like you're apologizing for causing an accident. Even if you think you may be partially to blame, don't say so. Let the police and insurance agents work out the specifics on their own.

3. If you're not wearing a helmet, it won't necessarily impact your case

Even if you're required to wear a helmet and weren't, that doesn't mean you can't collect compensation for a crash. A judge or jury may factor in many things before deciding if you can collect and how much you should collect for your injuries.
