Lawsuit targets California city after a fatal pedestrian accident

Issues of poor lighting and negligent design are at the forefront in a lawsuit targeting the city of Los Angeles. In April of 2016, two women, a 69-year-old mother and her 31-year-old daughter, died after being struck by a Subaru Forester. The auto-pedestrian accident occurred in the West Hills area at the intersection of Roscoe Boulevard and Jason Avenue. The daughter and sister of the victims has filed a suit against the city.

Reportedly, the Forester struck the two women as they were walking their dog across the intersection at about 8:20 p.m. The driver of the automobile stopped when the accident occurred and remained at the scene to speak with investigators. According to a police officer, the driver said it was dark and he did not see the pedestrians. The police officer called the incident a "tragic accident" and did not cite the driver of the Forester, who was driving at about the posted speed limit.

The speed limit on both Jason and Roscoe is 40 mph, but some who live in the area say that people often exceed this limit. Further, reports indicate that the intersection is poorly lit and does not provide a traffic signal or a sign warning motorists of the upcoming intersection. This alleged negligent intersection design and control are at the heart of the berea lawsuit.

This lawsuit shows that it is possible to seek a legal remedy based on negligence even if the driver was not immediately found at fault. All too often, auto-pedestrian accidents occur due to outside influences or conditions providing a foundation upon which victims can build a sound case.
