Can I obtain permanent disability from work truck accidents?

Residents of California can obtain permanent disability benefits if they suffer an injury that affects their ability to work for a living. Some can even obtain benefits if they are able to return to work down the road.

With so many trucks on the roads of the state these days, more and more accidents are occurring. Because of this, some truck drivers might suffer injuries from truck accidents. These injuries, if they cause the driver to miss time on the job, can lead to permanent disability benefits.

Even though many injured people return to work, they might still have some medical issues that remain with them for a prolonged time. Permanent disability benefits are determined using the following criteria:

-- The date of the work-related truck accident that caused your injury.

-- A primary physician or other doctor who is a qualified medical evaluator will evaluate you following the accident and determine whether or not your impairment will affect your ability to work.

-- The doctor will then explain your impairment in a percentage.

-- The percentage is part of a formula that also takes into account your age and occupation. Injuries suffered between April 19, 2004 and Jan. 1, 2013, diminished future earnings capacity is also included in the formula.

-- Injuries that occurred after Jan. 1, 2013 will not include diminished future earnings capacity. Employees injured on the job will also not be able to collect permanent disability for sexual dysfunction or sleep disorders that were not directly caused by the work injury.

-- A judge or disability evaluator will analyze the formula and determine how much permanent disability you are entitled to following the work-related truck accident.

Any employee injured in a Manhattan Beach, California, truck accident can appeal the rating issued by the doctor. This is done by contacting a claims administrator for a DWC form. This form requests a panel of three qualified medical evaluators to review your disability and how it affects your ability to work.
