Drivers who fall asleep at the wheel pose a unique challenge

When a car accident occurs, one of the main questions is what caused the accident. There are some cases where the issue is that the driver fell asleep at the wheel. This poses a unique problem for the victims who opt to seek compensation for the accident because it is often difficult to prove that the driver was asleep.

Drowsy driving is the suspected cause of more than 80,000 accidents, according to an estimate by the National Highway Traffic Safety Administration. This shows how big of a problem it is when drivers get behind the wheel when they are tired.

There are many reasons why a person might be drowsy while they drive. One reason is that they have taken medications that can lead to drowsiness. This medication can be prescription or over-the-counter. In that case, it might be easy to prove that the person was drowsy when the accident occurred.

In some cases, it might be necessary to examine what the person did in the day before the accident. For some circumstances, it may be necessary to prove that the person was awake for a full 24-hour period before the accident. This can be especially difficult because there are likely going to be some periods that can't be accounted for.

If you were struck by a driver who was thought to be drowsy, you might decide to pursue a claim. This can be a complex matter, so it is a good idea for you to seek out legal assistance to learn what strategies apply to your particular personal injury case.
