Pedestrian killed; driver's future uncertain after wreck

A pedestrian was killed in Redondo Beach on Oct. 18 after being struck by a driver in a Toyota Camry.

The Redondo Beach Police Department reported that the accident fatally injured a 48-year-old Chinese woman as she walked along the sidewalk bordering Torrance Blvd. shortly before noon.

Accident investigators are trying to determine the sequence of events that caused the 85-year-old Los Angeles driver to lose control of her car, swerve at the intersection of Francisca Ave., and careen onto the sidewalk and into the woman walking. Following the impact with the pedestrian, the car hit a cinder block wall and came to a stop upside down in an adjacent parking lot.

The driver was transported from the accident site with injuries that were believed to be non-life-threatening. The pedestrian died at the scene.

A sergeant with the Redondo Beach Police Department stated that they didn't believe that "speed, drugs or alcohol were involved," and they think the driver was attempting to avoid a traffic jam on Torrance when the accident occurred.

So far, no charges have been filed against the octogenarian driver. However, traffic investigators have yet to conclude their analysis of the accident. Witness statements, possible mechanical problems and the skid marks at the scene all may help them determine the reason for the woman swerving up onto the sidewalk.

The case may still wind up with the district attorney's office in Los Angeles County even though the driver's record is clean, as reported by the state Department of Motor Vehicles.

What many injured pedestrians don't realize is that criminal charges don't have to result from the accident in order for them to successfully pursue justice in the California civil courts.
