Motorcyclist suspected in pedestrian fatal not even cited

| Nov 23, 2015 | Auto-Pedestrian Accidents |

The legal system can be baffling. There are processes that must be followed. Police and prosecutors have to make judgment calls on whether a case warrants the filing of criminal charges, and if so, what those charges should be.

In cases where someone is injured or killed and no apparent action is taken at all it can leave the loved ones of the victim downright angry and wondering whether justice is possible. This seems to be the feeling being expressed by members of a neighborhood in Florence after what seems in their eyes to be an open and shut case of wrongful death.

The fatality happened earlier this month. According to official reports, a 60-year-old woman in a wheelchair was legally crossing at an intersection along Compton Avenue around 2:30 in the afternoon when she was struck by a motorcycle.

Witnesses say the motorcyclist had been recklessly doing wheelies on the street just ahead of the crash. When it struck the victim, they say she was dragged down the street for a distance. Emergency crews rushed her to the hospital but she didn’t make it.

What has relatives of the woman perplexed is that authorities did not arrest the 21-year-old motorcyclist in connection with the crash. They say officials didn’t even issue a citation.

At last word, police were still investigating the matter and seeking for witnesses to come forward. There are indications that criminal charges could be filed at some point down the road.

Even if charges are filed and a conviction obtained in the criminal justice system, it may be of little consolation to the loved ones of this woman. Who knows what the sentence will be?

Families and loved ones of victims should know that remedies for seeking compensation for the pain and suffering that has been inflicted may exist through the civil courts. To determine if a case exists, loved ones should consult with an experienced personal injury attorney.
